Lapsing Limited | Terms and Conditions

This document contains the terms and conditions that govern your use of the mobile application called Lapsing (the "App") provided by Lapsing Limited (the "Developer"). By downloading, installing, or using the App, you agree to be bound by these terms and conditions. If you do not agree, do not use the App.

1. License.

The Developer grants you a limited, non-exclusive, non-transferable, revocable license to use the App on your compatible device for your personal or commercial purposes. You may not copy, modify, distribute, sell, rent, lease, sublicense, or otherwise transfer the App or any part of it to anyone else without the prior written consent of the Developer. You may not reverse engineer, decompile, disassemble, or create derivative works of the App or any part of it. You may not remove any proprietary notices or labels on the App. You may not use the App in any way that violates any applicable law or regulation, or infringes the rights of any third party.

2. Updates and Changes.

The Developer may update, modify, or discontinue the App or any part of it at any time without notice or liability to you. You are responsible for downloading and installing any updates that the Developer may provide from time to time. The terms and conditions of this document may also change from time to time. Your continued use of the App after such changes constitutes your acceptance of the new terms and conditions. If you do not agree to the new terms and conditions, you must stop using the App and delete it from your device.

3. Privacy and Data Collection.

The Developer collects some personal data from you or your device through the App as outlined in a separate privacy policy that is available on the Developer's website or within the App. You should read and understand the privacy policy before using the App. By using the App, you consent to the collection and use of your personal data as described in the privacy policy. The App may also require access to certain features or functions of your device, such as camera, microphone, location, contacts, etc., in order to provide its services. You can choose to grant or deny such access when prompted by the App or your device settings. If you deny such access, some features or functions of the App may not work properly or at all. The Developer is not responsible for any data charges that may apply to your use of the App.

4. Disclaimer of Warranties.

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, or non-infringement. The Developer does not warrant that the App will be uninterrupted, error-free, secure, accurate, reliable, or compatible with your device or any other software or hardware. You use the App at your own risk and discretion.

5. Limitation of Liability.

To the fullest extent permitted by law, the Developer shall not be liable for any damages of any kind arising from or relating to your use of or inability to use the App, including but not limited to direct, indirect, incidental, consequential, special, exemplary, or punitive damages, even if the Developer has been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above exclusions or limitations may not apply to you.

6. Indemnification.

You agree to indemnify, defend, and hold harmless the Developer and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, liabilities, expenses, damages, and costs arising from or relating to your use of or misuse of the App or your violation of these terms and conditions.

7. Termination.

The Developer may terminate your license to use the App at any time for any reason without notice or liability to you. You may also terminate your license to use the App at any time by deleting it from your device. Upon termination of your license to use the App for any reason, you must cease all use of the App and delete it from your device.

8. Governing Law and Dispute Resolution.

These terms and conditions are governed by and construed in accordance with the laws of England and Wales without regard to its conflict of laws principles. Any dispute arising from or relating to these terms and conditions or your use of the App shall be subject to the exclusive jurisdiction of the courts of England and Wales.

9. Copyrights.

The App and all its content are protected by copyright laws and international treaties. All rights are reserved by the Developer and its licensors. You may not reproduce, distribute, display, perform, transmit, or create derivative works of any part of the App or its content without the prior written consent of the Developer or its licensors.

10. Payment.

The App offers some additional functionality and features that require you to pay a recurring fee to the Developer or a third-party provider such as the app stores or the Developer's website. You can choose from different subscription plans and payment methods as offered by the Developer or the third-party provider. You are responsible for paying any such fees and complying with any terms and conditions imposed by the Developer or the third-party provider. The Developer may change the fees or introduce new fees at any time without notice or liability to you. You may also be subject to additional charges or taxes by your device provider, network operator, or payment service provider. The Developer is not responsible for any such charges or taxes. The Developer does not provide any refunds or cancellations for any fees paid by you. Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the next renewal date. You can cancel your subscription at any time through the App settings or by contacting the Developer or the third-party provider.

11. Beta Software.

The App may include beta versions of software or features that are not fully tested or finalized by the Developer. You understand and agree that the use of beta software or features may cause errors, bugs, crashes, data loss, or other problems with the App or your device. You use beta software or features at your own risk and discretion. The Developer does not provide any warranties or liabilities for beta software or features. The Developer may modify, discontinue, or remove beta software or features at any time without notice or liability to you.
